1. Acceptance
By creating an account or using Position (the "Service"), you agree to these User Terms of Service, our Privacy Policy and our Acceptable Use Policy. If you do not agree, do not use the Service. If you are creating an account on behalf of a business, the Business Terms of Service also apply.
2. Eligibility
You must be at least 16 years old and legally able to enter into a contract to use Position. You are responsible for the security of your account and all activity that occurs under it.
3. Your Account and Content
- You retain ownership of the content you submit (profile, resume, cover letters, saved searches).
- You grant Position a worldwide, non-exclusive, royalty-free license to host, display, and process your content solely to operate and improve the Service.
- When you apply for a job, you authorize Position to share your application with the employer that posted the listing.
- You are responsible for the accuracy and lawfulness of information you provide.
4. Applications and Employment
Position is a discovery platform, not an employer or staffing agency. We do not participate in hiring decisions, verify listings beyond our internal moderation, or guarantee interviews, offers, wages, or working conditions. All employment relationships are strictly between you and the employer.
5. AI Features
Position offers AI-powered tools such as resume improvement, cover letter drafting, and job matching. AI output may contain errors or omissions. Review and edit AI-generated content before submitting it. Do not rely on AI output as legal, medical, financial, or professional advice.
6. Acceptable Use
You must comply with our Acceptable Use Policy. Violations may result in content removal, account suspension, or termination.
7. Intellectual Property
The Service, including its software, design, and trademarks, is owned by Position and its licensors. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.
8. Termination
You may delete your account at any time. We may suspend or terminate your access for violations of these terms, applicable law, or for any legitimate business reason. Provisions that by their nature should survive termination will survive.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, Position and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our aggregate liability for any claim arising from these terms is limited to the greater of $100 or the amount you paid to Position in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Position from claims arising out of your content, your use of the Service, or your violation of these terms or applicable law.
12. Governing Law and Disputes
These terms are governed by the laws of the State of South Carolina, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in South Carolina, and you consent to personal jurisdiction there. Nothing in this section limits your rights under mandatory local law.
13. Changes
We may update these terms. Material changes will be posted with an updated effective date, and continued use of the Service after changes take effect constitutes acceptance.
